Arizona Immigration Bill – SB 1070 Law Text
Pres. Obama slammed S.B. 1070 or the Arizona Immigration bill as the senate bill may violate civil rights. The Arizona Immigration law would require police to question people about their immigration status if there’s reason to suspect they’re in the country illegally.
Purpose of the S.B. 1070:
Requires officials and agencies of the state and political subdivisions to fully comply with and assist in the enforcement of federal immigration laws and gives county attorneys subpoena power in certain investigations of employers. Establishes crimes involving trespassing by illegal aliens, stopping to hire or soliciting work under specified circumstances, and transporting, harboring or concealing unlawful aliens, and their respective penalties.
Background of the Arizona Immigration Bill:
Federal law provides that any alien who 1) enters or attempts to enter the U.S. at any time or place other than as designated by immigration officers, 2) eludes examination by immigration officers, or 3) attempts to enter or obtains entry to the U.S. by a willfully false or misleading representation is guilty of improper entry by an alien. For the first commission of the offense, the person is fined, imprisoned up to six months, or both, and for a subsequent offense, is fined, imprisoned up to 2 years, or both (8 U.S.C. § 1325).
The U.S. Immigration and Customs Enforcement (ICE) is the primary authority for enforcing immigration laws. ICE was created in March 2003 as an investigative branch of the Department of Homeland Security. ICE was the result of combining the Immigration and Naturalization Service and the U.S. Customs Service.
Current statute defines criminal trespass in the first degree as a person knowingly entering or remaining unlawfully in areas related to residential structures, residential yards, real property subject to a valid mineral claim or lease under certain circumstances, property if the person defaces religious symbols or religious property, or critical public service facilities. Depending on the circumstances, criminal trespass in the first degree provides penalties ranging from a class 1 misdemeanor to a class 6 felony (A.R.S. § 13-1504).
In 2007, Arizona enacted the Legal Arizona Workers Act (LAWA), prohibiting an employer from knowingly or intentionally employing an unauthorized alien and establishing penalties for employers in violation. The U.S. Citizenship and Immigration Services office administers the Systematic Alien Verification for Entitlements (SAVE) Program. The SAVE Program, together with the Social Security Administration (SSA), administers E-Verify, which allows employers to electronically confirm the employment eligibility of all newly hired employees. LAWA requires all Arizona employers to use E-Verify to verify the employment eligibility of new hires. Proof of verifying the employment authorization of an employee through E-Verify creates a rebuttable presumption that an employer did not intentionally or knowingly employ an unauthorized alien.
The fiscal impact is unknown; however, there may be additional costs associated with criminal prosecution and detention of persons who are accused and convicted of the crimes established in this legislation. Additionally, the addition of new fines associated with this measure may also have an impact.

We are a nation of immigrants. LEGAL immigrants. We have had laws on the books since the nation was born concerning immigration. The laws are meant to protect the nation’s sovereignty and numerous protections for tax paying citizens. All countries have immigration laws and enforce them, especially Mexico. The US does not enforce its own immigration laws, for mysterious underlying reasons. We, the people of the US should demand our government follow its own laws. The laws are there for very good reasons. People keep confusing racism with immigration laws, raciscm has nothing to do with it. People say the immigrants are taking jobs Americans don’t want. That’s not true and never has been. You are all being fooled by greedy politicians who want to keep their imported voting base, by churches who need more attendance, and by US corporations who want cheap, agreeable labor. Such a shame. I’m ashamed of our President, who I voted for and believed in until he spoke in such an uneducated manner about the Arizona situation.
I agree with Lisa we the people already have law’s in effect it is they the government who does not enforce these law’s.

During Hitler’s Reign, every German citizen, and other citizens of countries controlled by the Reich, were ordered by law to carry proof of their ancestry to make sure that they were not of Jewish decent. This Immigration Bill sounds real close to Nazi Germany to me. Are there swastik flags hanging up at the Arizona State Capitol building??? I believe that as long as those who are here are working (which most work harder than those Americans milking the system)and trying to live a better life and obtain some sort of documnetation (that they do not have to whip out whenever ordered), then why not give them a chance at a good life?!? We are all descendents of people who came here to provide a better life for their families. Aside from the native Americans, we are all desscendents of immigrants. This law seems pretty Nazi to me.

I’ve read the bill. Where is the comparison between Nazi Germany and this bill? Nothing in the bill says they can stop anyone on the street and demand to see their “papers”. It states that during a LAWFUL detainment, if there’s reason to suspect an person is here illegally, the office can request proof of legal alienship…or whatever word it is.
The same holds true if I’m pulled over for a traffic violation. I have to provide my license, proof of insurance and vehicle registration. I’m proof I’m a leage resident. Why should an illegal alien be treaded differently?
You peeople who think this is similar to NAzi Germany need to have your heads examine. Try pulling them out of your a…out of the sand.
Possible profiling, potential for racist actions, what law doesn’t have potential negative effects. There are people saying this law has already affected them negatively. That just shows you the liberal, special interest spin on the matter; the bill hasn’t even gone into effect yet. Please read the bill people. The bill bends over backwards to protect the innocent and make sure that people don’t have to be anxious about their safety if they are not breaking the law. If they are breaking the law they should be paranoid. I like the statement that if i weren’t carrying my license or registration, or proof of insurance i would be fined or arrested. If I seemed to be acting suspiciously, hanging around, with no proof of I.D., I could be arrested. Why should a person coming from another country, breeching our border, be treated better than me!!! The Federal immigration laws that have been ignored by officials for so long were ramped up after 9-11 to protect America. If you don’t believe in America’s laws move to another country; walk across the border into Mexico-see how far you get!!!

This is in response to Mary Porter’s comment. Dear Mary, are you actually saying that you know anything about the Nazis? My family actually suffered under the Nazi occupation. They were arrested, beaten and some spent 3.5 years in a Concentration Camp in Sztuthof in Northern Poland. We are Catholics and the only crimes that they had committed were that they opposed the Nazi occupation and that they kept a Jewish family (their next door friends) in hiding for almost 3 years. How can you even compare the new Arizona Immigration law to Nazi’s laws. Please read the LAW first, then educate yourself about the other countries immigration laws. Virtually all countries in the world have much more immigration restrictive laws than the United States. Also, every country in the world (except US) requires its residence to carry identification cards all the time. Arizona law is a reflection of already existing US immigration law. Please don’t insult your fellow US citizen’s intelligence with your dumb and ignorant comment.
So what they’re basically doing is just working on the “Mexican” people? Well what about Asians or Europeans? So just Asians are supposed to be smart they get to stay here? I know that there isn’t such a big problem with them. But that’s still unfair. I’d like to see a law about Asians and Europeans too. Otherwise it’s like the USA are being “racist” against JUST “Mexicans”.
First and foremost we are a democratic country of laws – without ‘laws’ there is nothing but anarchy and chaos. Folks who are opposed to the Arizona bill need to read it first before commenting on it – please do so. What part of “illegal aliens” don’t you get? In New Mexico there are many legal immigrants from Mexico that went through the proper procedures to become United States citizens and they are appalled that “illegals” are not sent back to the country they came from. Of the estimated 11-15 million illegal aliens in this country about 60% are from Mexico therefore a large number are from other countries.
I am appalled that our President indicates this is ‘racial profiling’ and ‘discriminitory’ – he is so wrong.
Good for Arizona to pass SB 1070! New Mexico should follow Arizona’s endeavor. SB1070 was approved by the majority of people of Arizona through their legally elected representatives and senators in the Arizona Legislature and then signed by the Governor. SB 1070, simply put, allows state, county, local law enforcement to enforce the Federal Immigration Law as it should be in all states.
Albuquerque Mayor Berry has recently put into place a policy that requires all persons booked into the City jail to be checked for their immigration status by ICE. This is a great cooperative endeavor between the City law enforcement and the Federal Government. Good job Mayor Berry and Governor Brewer!
Ok. So, those of us you took the time and the initative to read the Arizona Senate Bill 1070 clearly understand that the bill itself contains explicit language that deters a law enforcement officer( and that is their duty, correct, to enforce the law?? duh!) from any racial profiling. The rest of the bill is rather straight forward, makes commonsense, and has the intent of clarifying if a person is in the US on either a legal or illegal basis. This is akin to asking a driver to produce a driver’s license, insurance and proof of ownership of the vehicle. If you do not have any of the three elements, then a law enforcement officer makes an investigation as to: if they are licensed to drive the vehicle (recall, this is not an automatic “right” to drive but a privelage to drive the road in that state), if they are properly insured for any damages or death, and if they truly own the vehicle or it the car is stolen. That is normal, accepted and commonsense considering there is a public policy beneath the surface of this law.
So, as stated, the Arizona SB is sound and very clear in its intent. On the other hand, critics of the bill have laid out outright lies, statements about this bill that are incorrect, based on false premises and have distorted the language of this bill to incite confusion, misunderstanding and “fear” among the public. It is even more shameful that our current President has made statements that create confusion and a distorted sense of the truth that is written in this bill. THAT is shameful and, furthermore, dangerous!
I’m not completely oppose to the Arizona law in it of its self. What makes me sick to my stomach are the comments that generalize “immigrants”. Some comments I hear often and more now with the new Arizona law, “immigrants take the jobs from our people”, “Those people should not be allow to enter our country”. I’m an immigrant. My grandmother work hard to earn the right for me and my family to enter the United States legaly. We went throu the process and paid the fees. But yet, by the comments of many, I’m lable as that immigrant who stold some elses job, I’m lable as “those people” that come just to commit crimes! There re many immigrants both legal and iligal who have done nothing but love, work, and fight for this country. I’m gratefull to God and bless for my grandmother who brought us leagally to this country but sadden for those good and hard working families that have to leave in fear and hidding from getting caught just to bring bread for their children. God only now what drives a good dad to risk his own live in the desert or river to bring food to the table.
Any one of you have the freedom to speak this stupid nonsense about illegals loving this country because our forefathers FOUGHT for our Freedoms!!!!
